Decreto del fare: per la giustizia e il processo civile
Il decreto del fare affronta il problema della giustizia civile che costituisce un freno alla crescita del Paese.
Lo stato della giustizia civile costituisce, senza dubbio, uno dei fattori di svantaggio competitivo per la società italiana, in particolare per chi produce e lavora.
- Siamo al 158° posto nel mondo nell’indice di efficienza di recupero del credito a causa dei tempi lunghi
- 1.210 giorni è la durata media dei procedimenti civili per il recupero crediti.
- Il numero di condanne riportate dallo Stato per violazione del termine della ragionevole durata dei processi è allarmante
COSA CAMBIA
Per far fronte a queste criticità il decreto contiene una serie di misure volte a:
Incidere sui tempi della giustizia civile e migliorarne l’efficienza
A tal fine si prevede:
- Il ripristino – per diminuire il numero dei procedimenti giudiziari in entrata – della mediazione obbligatoria per numerose tipologie di cause, con l’esclusione (richiesta dall’avvocatura) delle controversie per danni da circolazione stradale, il netto contenimento dei costi per la mediazione e l’adeguato coinvolgimento della classe forense;
- L’istituzione di stage di formazione presso gli uffici giudiziari dei tribunali. I giovani laureati in Giurisprudenza più meritevoli (valutati in funzione della media degli esami fondamentali e dalla media di laurea) potranno completare la predetta formazione presso i predetti uffici giudiziari, che si potranno avvalere del loro qualificato contributo;
- L’istituzione di un contingente di 400 giudici non togati per lo smaltimento del contenzioso pendente presso le Corti di Appello;
- L’istituzione della figura di assistente di studio presso la Corte di cassazione: 30 magistrati ordinari già in ruolo potranno essere assegnati dal CSM alle sezioni civili della Corte di Cassazione, per conseguire un aumento della produttività del settore, contrastando l’attuale tendenza ad un aumento delle pendenze (nel 2012 sono risultati quasi 100.000 processi pendenti).
- La possibilità – nell’ambito dei processi di divisione di beni in comproprietà (notoriamente lunghi) – di attribuire la delega a un notaio nominato dal giudice delle operazioni di divisione, quando ci sia accordo tra i comproprietari sulla necessità di divisione del bene.
Contribuire a ricostituire un ambiente d’impresa accogliente per gli investitori nazionali e internazionali fondato sulla certezza del credito
A tal fine si prevede:
- La concentrazione esclusiva presso i Tribunali e le Corti di appello di Milano, Roma e Napoli delle cause che coinvolgono gli investitori esteri (senza sedi stabili in Italia) con lo scopo di garantire una maggiore prevedibilità delle decisioni e ridotti costi logicistici.
- La revisione del cosiddetto concordato in bianco. Lo strumento è stato introdotto nel 2012 per consentire all’impresa in crisi di evitare il fallimento e di salvare il patrimonio dalle aggressioni dei creditori con la massima tempestività (depositando cioè al tribunale una domanda non accompagnata dalla proposta relativa alle somme che si intendono pagare ai creditori). Per impedire condotte abusive di questo strumento (cioè domande dirette soltanto a rinviare il momento del fallimento, quando lo stesso non è evitabile) emerse dai primi rilievi statistici, si dispone che l’impresa non potrà più limitarsi alla semplice domanda iniziale in bianco, ma dovrà depositare, a fini di verifica, l’elenco dei suoi creditori (e quindi anche dei suoi debiti). Il Tribunale potrà, inoltre, nominare un commissario giudiziale, che controllerà se l’impresa in crisi si sta effettivamente attivando per predisporre una compiuta proposta di pagamento ai creditori. In presenza di atti in frode ai creditori, il Tribunale potrà chiudere la procedura; nel giudizio di opposizione a decreto ingiuntivo, la previsione che il giudice quando è presentata opposizione a decreto ingiuntivo debba fissare la prima udienza non oltre 30 giorni e, in quella sede, decidere sulla provvisoria esecuzione.
LE ASPETTATIVE
Per effetto delle misure introdotte ci si attende, nei prossimi 5 ANNI, un consistente abbattimento del contenzioso civile, nonché un incremento dei procedimenti definiti. In particolare:
- TRIBUNALI Definiti in 5 anni: + 675.000
- APPELLO Definiti in 5 anni: + 262.500
- CASSAZIONE Definiti in 5 anni: + 20.000
IMPATTO TOTALE IN 5 ANNI
- Maggiori definiti: + 957.500
- Minori sopravvenienze: – 200.000
- Minori pendenze complessive: 1.157.000

Perchè non hanno deliberato la modifica al CPP per introdurre, come ce lo chiede l’Europa, la sospensione dei Processi nei confronti di imputati irreperibili?
Circa il 25% dei procedimenti penali che intasano i nostri Tribunali sono con imputati che non sono nemmeno conosciuti dai loro avvocati, pagati dallo Stato, che rappresentando i loro assistiti trascinano sistematicamente i processi fino alla Cassazione.
Questa modifica permetterebbe di mettere mano alle notifiche che sono lo strumento usato per dilatare fino alla prescrizione i processi.

in tema di ripristino della MEDIAZIONE CIVILE OBBLIGATORIA, Le chiedo:
non pensa che il fatto di aver stabilito che “gli avvocati sono mediatori di diritto” possa creare discriminazioni tra conciliatori-avvocati e conciliatori-dottori in giurisprudenza, con la conseguenza che gli incarichi possano essere assegnati dall’Organismo ai primi a discapito dei secondi?
La mediazione non doveva forse essere ANCHE un’occasione professionale per i LAUREATI DISOCCUPATI ?

Una critica a proposito dello stage di formazione presso gli uffici giudiziari dei tribunali.L’età richiesta per gli aspiranti è in contrasto con quella del ministro della Giustizia (70 anni,allora è contro la sua categoria di anni 70 ,se è lei contro i vecchi figuriamoci i giovani)il voto di alcuni esami e il voto di laurea sono indizi di bravura non prove;pertanto i requisiti richiesti sono dettati da stereotipi non da criteri di formazione culturale , apprendimento e vari tipi di intelligenza.Siamo sempre pieni di pregiudizi ai voti stanno attenti solo i bambini della primaria.
Sono d’accordo con lei e aggiungo che nel risolvere il caso pratico spesso sono più bravi dottori in Giurisprudenza che avvocati con anni di esperienza;un mio bravissimo prof.era solito ricordarci che la bravura si vede in campo.Molti 110 e lode hanno rifatto tre volte l’esame per l’abilitazione di avvocato;altre con 110 e lode e il massimo dei voti nelle tre prove scritte(cioè 40)non hanno capito come fare la domanda per il concorso in Magistratura.Tutto in regola sulla carta ma nessuna capacità di apprendimento.Come si spiega?Siamo ancora legati ai vecchi sistemi valutativi a cui sono ineressati solo i bambini.L’inelligenza e la formazione è altro cioè non puro nozionismo.

Chi Le scrive, da molti anni, conduce insieme alla maggior parte degli ufficiali giudiziari italiani che si riconoscono nell’AUGE (Associazione Ufficiali Giudiziari in Europa), che ho l’onore di rappresentare, una battaglia per innalzare il livello di qualità del servizio offerto dagli ufficiali giudiziari italiani.
La proposta che desidero sottoporre alla Sua attenzione è volta a migliorare l’efficienza dei procedimenti di esecuzione mobiliare vista dalla parte di chi conosce bene l’esasperazione del cittadino di fronte ad una giustizia italiana da terzo mondo. Inoltre la nostra esperienza non si limita sul campo, ma facciamo parte delle più grandi organizzazioni internazionali di categoria e ciò ci consente di confrontarci, da anni, con gli ufficiali giudiziari di tutto il mondo, di valutare pregi e difetti delle procedure esecutive adottate negli altri Paesi e di compararli con le nostre normative.
La strada seguita nella proposta è quella dell’implementazione dei poteri di ricerca dei beni dell’ufficiale giudiziario, colmando l’asimmetria informativa esistente tra i creditori e il debitore in merito agli “asset” patrimoniali appartenenti a quest’ultimo e puntando inoltre su una più efficace applicazione degli strumenti giuridici.
Nei nostri numerosi incontri con tutte le forze politiche abbiamo illustrato ampiamente, senza successo purtroppo, quanto a nostro avviso, una figura autorevole di ufficiale giudiziario operante in un regime di libera concorrenza sia la soluzione ottimale per ridare slancio al nostro processo esecutivo sempre più impreparato alle esigenze legittime dei cittadini, e sempre più inadeguato all’evoluzione tecnologica che caratterizza, oggi più che mai, la nostra società.
Siamo tuttavia consapevoli che i grandi traguardi si raggiungono con i piccoli passi. Le proposte che seguono pertanto pur conservando all’ufficiale giudiziario lo status di dipendente pubblico tendono tuttavia a configurargli una forma mentis da libero professionista, attento alla qualità del servizio offerto alla propria utenza.
Alla luce di quanto esposto quindi abbiamo ritenuto opportuno innanzitutto individuare le basi su cui costruire una riforma che possa finalmente spazzare via le contraddizioni che caratterizzano l’attività dell’ufficiale giudiziario imbrigliato nella struttura pubblica, ossia la lentezza del suo procedere e l’ inefficacia della sua azione
L’inefficacia e l’inutilità delle procedure esecutive italiane rappresentano un fenomeno devastante per la vita delle imprese, al punto da condizionare fortemente l’attività economico-produttiva ed, in alcuni casi, addirittura mettere a repentaglio la sopravvivenza delle stesse. Inoltre, nel cittadino comune che constata la facilità con cui si possa beffare la legge ed eludere un provvedimento giudiziario, viene meno la credibilità dello Stato di diritto ed il rispetto per l’ordinamento, con la conseguente tentazione – che in certe aree del Paese, purtroppo, è diventata realtà quotidiana – di ottenere per vie illecite il soddisfacimento dei propri diritti, anche con il coinvolgimento della criminalità organizzata.
Se partiamo dal presupposto che uno Stato che non garantisce l’esecuzione dei suoi giudizi è uno Stato che indebolisce la sua sicurezza giuridica ed allontana gli operatori economici stranieri, occorre interrogarsi su cosa manchi al sistema giudiziario italiano affinché si possano ottenere esecuzioni dei suoi giudizi in tempi brevi e con risultati certi e cosa manchi all’ufficiale giudiziario italiano per equipararsi agli standard europei.
Noi vogliamo fare la nostra parte, e attendiamo un Suo autorevole parere, anche negativo, ma che ci aiuti a far decollare un nuovo processo esecutivo e porre fine ad un legislatore che in tutti questi anni ha solo fatto danni, non solo all’immagine dello Stato italiano, ma ad ogni singolo cittadino.

Onorevole LUPI, Le sembra giusto che una persona che abbia maturato un solo anno e mezzo di esperienza all’interno di uno studio legale abbia superato l’esame per l’abilitazione di avvocato, mentre altri candidati, che collaborano con uno studio legale, da due e spesso più anni debbano sostenerlo nuovamente? Le sembra giusto che i primi diventino mediatori di diritto ed i secondi, nonostante l’esperienza di cui sopra, debbano affrontare un percorso formativo più arduo con il rischio di non ottenere mai alcun incarico di MEDIAZIONE, proprio perchè non abilitati alla professione forense?
