Consiglio dei Ministri n.16: nuovo Codice della Strada
Comunicato stampa del Ministero delle Infrastrutture e Trasporti sul nuovo Codice della Strada
Il consiglio dei ministri di oggi ha approvato il decreto legge di delega al governo per la stesura di un nuovo codice della strada. “Le nuove normative avranno come capisaldi:
- La sicurezza delle strade
- La prevenzione
- L’educazione degli utenti della strada
LAVORO DI SEMPLIFICAZIONE
Ci sarà da fare innanzitutto un grande lavoro di semplificazione. L’attuale codice è composto da 240 articoli, a cui si aggiungono i 408 del regolamento di esecuzione. Dal 1992 a oggi è stato oggetto di più di 70 interventi legislativi, che ne hanno compromesso l’organicità e la chiarezza.
IL NUOVO CODICE
Il nuovo codice avrà poche norme mentre tutto ciò che è adeguamento allo sviluppo tecnologico e alle disposizioni europee, che sono in continua evoluzione, troverà spazio nel regolamento, che è modificabile in modo più celere.
ALCUNE NOVITA’
Una grossa novità riguarderà le patenti per i motorini e per le minicar, ottenibili già a 14 anni. Sinora ai minorenni non potevano venire applicate le sanzione in cui incorre l’adulto con la patente a punti. Con il nuovo codice queste patenti sono in tutto uguali a quelle a punti, e potranno venire sospese e ritirate.
SICUREZZA DELLE STRADE
Per la sicurezza delle strade, da cui dipende ancora il 15% dei morti per incidente, bisognerà intervenire sulla progettazione, la manutenzione e la segnaletica soprattutto per tutelare gli utenti più deboli: motociclisti e ciclisti. Per esempio i guard rail andranno ripensati nella forma sia quelli in cemento sia quelli in ferro, causa spesso di lesioni gravissime per i guidatori delle due ruote.

SULLE MULTE
Infine una nota sulle multe. Oltre a inserire un criterio di premio per gli automobilisti virtuosi e di severità per i recidivi (confermo che diventerà strutturale quanto già contenuto nel Decreto del fare sullo sconto del 30% per chi paga subito), bisognerà armonizzare gli iter per i ricorsi.
E’ un po’ strano che chi oggi fa ricorso al prefetto e se lo vede respinto si veda anche raddoppiata la multa, cosa che non succede per chi fa ricorso al giudice di pace. Bisognerà chiarire, eliminando condizioni vessatorie, per quali ricorsi ci si debba rivolgere all’uno e per quali agli altri.

vorrei pensare che oltre ai doveri da parte degli automobilisti, si possano individuare responsabilità di chi appone cartelli di limiti di velocità che non hanno senso se non quello di rendere le strade facili trappole per multe o sanzioni. Ci sono cartelli dimenticati indicanti la velocità di 10, 30, 50 all’ora privi di qualunque motivazione legata alla sicurezza. Bisogna ripensare tutta la segnaletica e fare una autentica bonifica dei cartelli inutili, rendendo di più facile lettura quelli utili. Possibile che l’Anas e le province spesso, per tutelarsi si limitino ad apporre cartelli con limiti di velocità ridicoli in attesa di riparazione di qualche buca? Perchè non prendere in considerazione che il livello di sicurezza delle attuali automobili consentono una frenata nettamente più sicura di quanto non accadesse 40 anni fa? Non sono uno che ama correre, vado piano, ma appunto per questo, mi rendo conto che nonostante vada piano sono sempre a rischio multa perchè i limiti sono eccessivamente bassi. ….Ministro, per favore, parli di semplificazione quando riesce ad eliminare il PRA che è un “doppione della motorizzazione” e sta facendo chiudere tanti sportelli telematici “agenzie private STA” perchè fa concorrenza sleale potendo “lavorare” le pratiche senza alcuna tariffa, ne iva e ne tasse ed incassando emolumenti anche dalle agenzie stesse che le pratiche le lavorano nei propri uffici,in via telematica,e a proprie spese!! come spiegare ai cittadini che noi non siamo il pra?? e poi, pensi al risparmio in termini di spesa pubblica e di costo delle pratiche se esistesse solo l’archivio della motorizzazione!!! FACCIA UNA VERA SEMPLIFICAZIONE !!!

Caro Maurizio, una revisione del CdS va più che bene (anche se sicuramente sai che a più di 20 anni dall’introduzione dell’attuale codice, in moltissimi comuni c’è ancora segnaletica orizzontale e verticale mai adeguata alle nuove norme…) Per quanto riguarda le sanzioni, sai bene che è impossibile togliere il diritto al ricorso alla magistratura, visto che è un diritto costituzionale. Propongo invece, in analogia con altri settori, una specie di conciliazione: la possibilità per conducente di fare un ricorso all’ente stesso che ha emesso il verbale (qualcosa come una richiesta in autotutela, o una conciliazione come nelle controversie fiscali) che a quel punto, con uno staff di persone diverso da quello che ha emesso l’atto, ne giudichi la legittimità in tempi rapidissimi (30 giorni), eliminando lo stucchevole ricorso al Prefetto (quasi sempre burocratico e che raramente giudica nel merito). Se la conciliazione non riesce, si può fare il ricorso al GdP: se perde il conducente, raddoppio della sanzione (detraendo il contributo unificato, però…), se perde l’Ente, un rimborso pari a 10 volte la sanzione, oltre alle eventuali spese legali. Così l’Ente impara a fare verbali insostenibili…
Cerchiamo di dare un’educazione stradale anche ai ciclisti che non rispettano nulla e la stra maggior parte di loro sono in possesso di patente di guida .
Passano con il semaforo rosso, camminano contro mano, occupano tutta la carreggiata dcc…….
Importanti cambiamenti, ma introdotto il reato di omicidio preterintenzionale per chimuccide una persona sotto l’effetto di droga e di alcool. Inoltre bisogna tutelare cicli e motocicli, ma anche loro devono incominciare a prendersi multe salate per il continuo non rispetto del codice della strada.

Lei li descrive “utenti più deboli”.
Se Lei venisse da Erba verso Canzo e Civenna, soprattutto il sabato e la domenica, Le assicuro che cambierebbe letteralmente idea.
Si sentono i padroni della strada, costringendo gli automobilisti, che magari sono in giro per lavoro, ad avanzare alla loro stessa andatura perchè si mettono in tre per fila e bloccano il traffico!!!
Regoli anche questo grosso problema.

Bel colpo, un nuovo codice della strada…

Il recente disastro dell’Irpinia, ha messo in evidenza un solo punto. La sicurezza sulle strade si fa con il codice e con una politica responsabile. Sono nel settore dei trasporti e posso solo permettermi di dirLe che da decenni i governi hanno trovato sulle auto e sul loro indotto l’Eldorado delle tasse. Questa politica non solo ha creato lo stallo del settore ma ha eroso i margini della sicurezza stradale dei trasporti pubblici e privati. Ci sono migliaia di persone che circolano senza rca ed altrettante che rinunciano alle riparazioni sulle auto (spesso inerenti la sicurezza) per mancanza di soldi. Le aziende private fanno fatica a mantenere efficenti i mezzi di trasporto a causa dei costi assurdi imposti da decenni di politiche inette. Lei ieri affermava in tv che i responsabili del disastro successo in Irpinia sarebbero venuti fuori, ebbene cercare il capro espiatorio è la cosa più semplice ma da nessuna parte politica arriva mai il mea culpa che stabilisca una volta per tutte che l’eccessiva tassazione sulle auto ed il mantenere vive le lobbies delle assicurazioni è la causa primaria di questi disastri che un paese civile non dovrebbe permettersi. Lei, da poco ministro, di certo non si sentirà colpevole ed a ritroso nessuno dei suoi precedessori acceterà la sua coscienza sia pubblicamente sporca del sangue di vittime innocenti, che forse per risparmiare hanno scelto un’azienda che a sua volta per poter lavorare avrà risparmiato sulla sicurezza di un mezzo. Questa è la verità che da una confortevole e sicura auto blu Lei ed i suoi colleghi non percepirete mai, andando a cercare i responsabili di un disastro che ci dovrebbe far vergognare tutti.
Può essere modificata la norma in vigore che chi supera il limite di velocità e riceve una multa da pagare se non comunica i dati della persona al volante riceve una seconda multa molte volte più salata della prima? Dovrebbe essere scontato che se ha pagato la prima multa ne accetta tutte le conseguenze e responsabilità quindi anche quella di decurtazione dei punti dalla propria patente? Grazie per l’attenzione.
Grazie Dario per il suo commento. La sicurezza stradale è stata da subito al centro della mia azione da Ministro. Per esempio sta per essere approvato nel “dl Fare” un piano Anas di manutenzione straordinaria, arrivano nuove risorse e nel nuovo codice della strada si tutelano le categorie più deboli.
